Eligibility

You must be at least 18 years old to create an account and use the Service.

By using the Service, you represent and warrant that:

• You are legally permitted to use the Service in your jurisdiction
• You will comply with these Terms and applicable laws

Description of Service

Upscalibur provides tools to:

• Upload video or GIF files
• Upscale video resolution using AI technology
• Download processed video outputs
• Use AI-assisted support features

The Service operates on a usage-based credit system using UPS tokens.

There is no recurring subscription. All purchases are optional and one-time.

File Limits and Technical Restrictions

The Service supports video and GIF formats including MP4, MOV, WEBM, M4V, and GIF.

Uploaded files are subject to technical limitations, including maximum file size, duration, resolution, frame count, and scaling limits.

At the time of publication, typical limits include:

• Maximum file size: 50 MB
• Maximum duration: 30 seconds
• Maximum upscale factor: 8×

These limits may change from time to time as the Service evolves.

UPS Tokens – Nature of Credits

UPS tokens are digital service credits used solely within the Service.

UPS tokens:

• Have no monetary value
• Are not electronic money or stored value
• Are not transferable
• Cannot be redeemed for cash
• Represent prepaid access to platform features

Token System and Payments

Users may purchase UPS tokens via secure third-party payment processors.

Pricing, minimum purchase amounts, discounts, and bonus credits are displayed on the Pricing page.

After successful payment:

• Tokens are credited automatically to your account
• Processing delays may occur due to payment provider verification

Unless required by law:

• Tokens are non-refundable
• Used or partially used tokens are non-refundable
• Chargebacks may result in account suspension

We reserve the right to correct pricing errors or revoke tokens obtained through technical or billing errors.

Anti-Fraud and Risk Monitoring

We actively monitor transactions and platform activity for fraud, abuse, or suspicious behavior.

We may:

• Suspend accounts
• Delay or refuse transactions
• Restrict token balances
• Request identity verification

Where fraud or abuse is reasonably suspected, access to tokens or services may be revoked without liability.

User Accounts

You are responsible for maintaining the confidentiality of your login credentials.

You agree to notify us immediately of any unauthorized use.

We are not responsible for losses resulting from compromised credentials.

You may delete your account at any time.

Acceptable Use

You agree not to use the Service:

• For unlawful or harmful purposes
• To process content that violates intellectual property rights
• To attempt to reverse engineer or disrupt the Service
• To bypass payment or usage controls
• To upload malicious, abusive, or illegal content

We may suspend or terminate accounts for violations.

Content Responsibility

You are solely responsible for the content you upload to the Service.

By uploading content, you confirm that:

• You own the content or have the legal right to process it
• The content does not violate intellectual property rights
• The content does not contain illegal, abusive, or harmful material

We reserve the right to remove content or suspend accounts that violate these requirements.

AI Processing and Output Quality

The Service uses artificial intelligence models to process and upscale video content.

While we aim to improve visual quality, results may vary depending on the source material.

We do not guarantee that processed outputs will meet specific expectations, production standards, or professional requirements.

Users acknowledge that AI-generated improvements may produce unexpected visual artifacts or variations.

File Processing and Storage

Files uploaded to the Service are processed temporarily for the purpose of generating outputs.

We do not permanently store user files.

Processed outputs and temporary files may be automatically deleted after processing or after a limited retention period.

Users are responsible for downloading their results after processing.

Service Abuse and Technical Protection

To maintain fair access and system stability, we may limit or restrict usage that places excessive load on the Service.

We reserve the right to:

• Temporarily throttle processing requests
• Restrict accounts engaging in abusive usage patterns
• Suspend or terminate accounts that attempt to bypass technical limits or payment systems

Intellectual Property

You retain rights to your uploaded video content.

We grant you a non-exclusive license to use processed output files generated by the Service.

We retain all rights to the platform, software, AI systems, branding, interface, and documentation.

You may not copy, resell, or replicate the Service.

Service Availability

We aim to maintain reliable service but do not guarantee uninterrupted operation.

We may modify features, suspend access, perform maintenance, and update systems.

Users are responsible for downloading processed outputs after generation.

Limitation of Liability

To the fullest extent permitted by law, the Service is provided “as is” and “as available”.

We do not guarantee:

• Perfect upscaling results
• Suitability for professional or commercial use
• Error-free or uninterrupted operation

We are not liable for indirect damages, loss of profits, data loss, business interruption, or third-party actions.

Your use of the Service is at your own risk.

Refund Policy

Except where required by law, all purchases are final.

Tokens consumed for services are non-refundable.

Refunds may be considered only in cases of verified technical failure.

Privacy

Your use of the Service is subject to our Privacy Policy.

Suspension and Termination

We may suspend or terminate access if:

• Terms are violated
• Fraud is suspected
• Legal obligations require it
• Service misuse occurs

Termination does not entitle you to refunds except where legally required.

Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of London, England.

Changes to Terms

We may update these Terms periodically.

Continued use of the Service constitutes acceptance of updated Terms.
